He is entitled, but chooses not to. (And wisely so.)  

However, the case was even mentioned in the Tuesday edition of
the Oregonian, so I guess I can mention something about it.  (I
did know something about it beforehand.)

Randal is being tried on felony charges of breaking into
computers at Intel.  Randal was working as a consultant for them
at the time.  One night one of the operators noticed Crack
running on one of their password files, charges were subsequently
brought against Randal.

I think we can all agree that if Randal had actually
wanted to break into Intel, he would have been able to do it, and
they wouldn't have noticed.  

I think he was trying to prove to them that their security was
lax.  It sounds to me that they (Intel) didn't even have shadow
passwords installed... so to say their security was lax is the
equivalent of saying 'Mt. Everest is a large hill.'  (I say this,
because Randal has done the same for us...)

At worst, Randal is guilty of poor judgement.

Maybe Intel is just trying to cover up an embarrassing (to them)
incident by blowing it out of proportion.

It's been pointed out on the pdx.* groups that Intel has proved
their point, costing Randal several tens of thousands of dollars
for defense.  The potential jail time is on the order of 90 days,
so it could be argued that the money spent on the defense is
arguably a worse punishment.

Just another person who think Randal's innocent.
