  • A demurrer is a plea to dismiss charges. Hearing transcript consists of discussion among the defense attorney (Marc Sussman), prosecutor (Thomas J. Tintera), and judge (Honorable Gayle Nachtigal). Demurrer was denied. Hearing on July 1, 1994.
  • Defense's memorandum in support of demurrer: memo and both parts of appendix (81k) | GZIP format (25k). Appendix contains a list of places where the word "authorize" is used in Oregon State law.
